Coimbatore: Champion Textiles Ltd. has secured Rs. 7.75 crore in compensation from JMJ Housing Ltd. following a ruling by an arbitral tribunal regarding a contentious residential development project. This decision, issued on October 12, 2026, stems from issues related to a Joint Development Agreement (JDA) established in January 2022.
Former Madras High Court Judge Justice T. Ravindran served as the sole arbitrator in the case, identified as Arb. O.P. (Com. Div.) No. 394 of 2024. The tribunal’s verdict reveals serious breaches of the initial agreement between the two parties.
The controversy emerged from land in Pattanam village, intended for residential construction under the JDA signed by Champion Textiles, represented by Managing Director V.R.S. Natarajan, and JMJ Housing Ltd., represented by Director Wilson P. Thomas. Under the agreement, the firms were to share responsibilities and benefits associated with the development.
However, disputes arose concerning the construction obligations and alleged unauthorized transfers of specific plots to third parties, without appropriate agreementsāviolating the provisions set forth in the General Power of Attorney.
JMJ Housing contended that they had invested significantly in preparatory work and incurred substantial costs on the project. Nevertheless, Champion Textiles pressed ahead with claims, citing unauthorized transactions as detrimental to their interests.
The tribunal, after a thorough examination of the documents and testimonies presented, sided with Champion Textiles on the primary contractual disputes. The arbitratorās findings indicated that JMJ Housing failed to comply with the obligations detailed in the JDA, particularly regarding the management of property transactions.
As part of the ruling, the tribunal deemed several transactions involving the disputed plots inconsistent with the stipulated contractual terms. Consequently, it ordered the cancellation of ten specific sale deeds linked to the property involved.
The financial aspects of the award mandated that JMJ Housing Ltd. and its director pay Champion Textiles a total of Rs. 7.75 crore, with Rs. 6.75 crore accruing interest at 18% per annum from March 13, 2025, until full payment is made. In addition to this, they ordered an extra Rs. 1 crore, also subject to an 18% interest until reimbursement.
Furthermore, the tribunal has instructed the respondents to deliver vacant possession of the disputed property back to Champion Textiles within a month of the ruling. These steps are part of the relief granted based on the tribunal’s determination of breaches within the development agreement.
The arbitration proceedings unfolded against competing claims regarding the responsibilities of each party and the validity of numerous transactions with third parties. Champion Textiles sought not only monetary compensation but also the annulment of illicit transactions and recovery of possession.
While both firms presented divergent perspectives, the tribunal’s award contained a comprehensive assessment of evidence, leading to a clear verdict in favor of Champion Textiles. The implications of this awardādated October 12, 2026āremain to be seen, as the enforcement of its directives will follow the judicial process.
